Senate Bill 1698 was filed in early January of 2024, and has since been passed by both parties and sent to Governor DeSantis to be signed into law.
It is at this point anyone’s guess as to whether Governor DeSantis signs Senate Bill 1698, what modifications will be made to the bill before then, and on what timeline these changes would take effect, but lets take a look at the way things stand currently.
What is Delta 8?
Delta-8 is a cannabinoid similar to Delta-9, which is commonly referred to as Marijuana or Weed. Delta-8 however, in order to be sold in states where Marijuana is recreationally illegal, is produced from industrial hemp as compared to they marijuana plant. The definitions of what is considered industrial hemp gets a little confusing as these guidelines are set federally by the 2018 Federal Farm Bill, but states such as Colorado and now potentially Florida have outlawed Delta-8 contrary to the federal guidelines. Delta-8 is commonly referred to as “baby-weed,” but when produced from a company such as Blue Moon Hemp, proper concentration balances result in an even stronger and pure feeling “high” as opposed to the marijuana plant.

What does Senate Bill 1698 say?
There have been a few modifications to the bill thus far, but currently the bill states that all manufacturing and sale of delta products, including THC-A, are to be outlawed unless they are under 5mg dry weight, which if you look at the shelves at your vape store, few if any at all current delta products on the shelves are even close to meeting this criteria.
5mg dry weight is essentially the equivalent to micro-dosing mushrooms, but instead of improved focus, you would likely experience similar effects to CBD, such as feeling slightly calm or up-lifted. So what is the good news for the THC industry in Florida? This just means that people need to buy and consume more delta products in order to get the same affects that just one edible for example currently provides.
When do these changes take affect?
The current time-line for this bill to take affect is October of 2024, but as we know, the government consistently misses deadlines. The bill is likely to face a couple appeals if it is signed, which will push the effective date back even further, so as of now, it is anyone’s guess when these changes would actually take affect.
